Liability waiver

1. Liability Waiver

1.1 To the fullest extent permitted by law, you hereby release and forever discharge Momentum 360 from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses howsoever arising that you may have directly or indirectly incurred, arising from or in connection with your entering into an Agreement with, and/or use of Momentum 360’s facilities and equipment, or from being on studio premises and whether caused or contributed to (directly or indirectly) by an act of negligence, breach of duty or default/omission on the part of Momentum 360 and its respective owners, directors, officers, employees or agents.

1.2 You agree that Momentum 360 will not be liable for any loss, damage or theft of any of your (or your guest’s) property except where caused directly by the gross negligence of Momentum 360.

1.3 To the full extent permitted by law, Momentum 360 will not be liable for any death, personal injury or illness occurring on studio premises or as a result of use of facilities or equipment, except to the extent that it arises from the gross negligence of Momentum 360 and its respective owners, directors, officers, employees or agents.

2. Participant Consent

2.1 In case of emergency, I authorise Momentum 360 to contact the nearest doctor/hospital and organise any medical attention on my behalf. I accept responsibility for any costs incurred and release Momentum 360 and its employees from any liability for injury during the training program.

Refund Policy (Purchases)

Momentum 360 will only exchange or refund if the item purchased is defective or damaged. We do not refund or exchange if you change your mind or you misused the product in a certain way against the advice of the business or were unclear about what you wanted.

Refund Policy (Services & Membership Fees)

Refund for services will only be granted if a medical certificate is provided stating you cannot continue with an exercise program. Refunds are not provided if you change your mind.
