CONSENT FORM
In exchange for utilizing the services of BC Sweat Buckhead, LLC dba Perspire Sauna Studio Buckhead (“Perspire”), a Georgia limited liability company and an independent franchisee of SWEAT EQUITY GROUP, LLC, a California limited liability company (“Franchisor”), the undersigned acknowledges that he/she has read and fully understands the following terms, knowingly assumes the risks, and waives his/her rights concerning liability as set out below.

Please consult your physician if you are pregnant, on medication, or if you have any questions regarding your ability to use an infrared sauna and/or cold shower modalities due to health reasons. NO INFORMATION WE PROVIDE YOU WITH RESPECT TO INFRARED SAUNAS, COLD SHOWERS, HALOTHERAPY, OR CONTRAST THERAPY IS MEDICAL ADVICE, AND WE DISCLAIM ALL LIABILITY WITH RESPECT TO ANY BELIEF THAT SUCH INFORMATION IS MEDICAL ADVICE.

INFRARED SAUNA / COLD SHOWER / HALOTHERAPY / CONTRAST THERAPY AGREEMENT / ACKNOWLEDGEMENT

1. You must be 18 years of age or older to use Perspire’s infrared sauna alone. With management permission, minors 16 to 17 years of age may use the sauna so long as a parent or guardian executes the consent form and waiver of liability on behalf of the minor and accompanies the minor every session.

2. Using an infrared sauna and/or cold shower can cause light-headedness, dizziness, heat exhaustion, or hypothermia. You should stay hydrated by drinking at least 8oz of water before, during, and after your session, and eat something beforehand. Stop using the sauna if you feel unwell. Cold showers can reach temperatures as low as 45°F; use them with caution. Start with brief exposure to assess your tolerance and gradually increase the time as comfortable. Severe reactions like heat stroke or cold shock can be life-threatening. Before combining halotherapy with an infrared sauna, consult your healthcare provider, particularly if you have any pre-existing health conditions. Discontinue use immediately if you experience discomfort or health concerns.

3. The use of medication, drugs, or alcohol prior to or during the sauna session may lead to dizziness or unconsciousness.

4. Sauna sessions are limited to 40 minutes, and temperatures must stay below 170 degrees Fahrenheit. Cold shower exposure should be adjusted based on personal comfort and health conditions.

5. You are limited to one (1) 40-minute sauna session daily (not per studio).

6. If you are late for your appointment, time will be deducted from your session.

7. If you book an appointment and need to cancel, you must do so within two hours of the scheduled time. Late cancellations (less than two hours before appointment) will result in a $20 late cancellation fee and will be charged to your card on file.

8. If you do not attend your appointment, a $20 no-show fee will be charged to your card on file.

9. Inappropriate behavior or activities will not be tolerated. Guests exhibiting inappropriate behavior will be required to leave the studio and may not be allowed to return.

10. Smoking and vaping are prohibited in the studio at any time. Offenders will be banned.

11. Firearms are always prohibited in the studio. Offenders will be banned from the premises.

12. If you cause damage to any Perspire property, including, without limitation, physical damage, water damage, damage due to harmful substances or odors, or damage from bodily fluids other than perspiration, you will be required to pay a damage fee which will be charged to your card on file.

CONTRAST THERAPY USAGE
I acknowledge that the use of Contrast Therapy is not a medical procedure. I understand and agree to consult with my doctor prior to using the product, and I agree to advise all users of the product to consult with their doctor prior to use. I acknowledge that the product has not been tested or approved by the FDA or any government agency for the treatment of any illness or disease. Therefore, I should not, and agree to advise all users of the product not to, use the product if pregnant, have heart conditions or other medical conditions negatively impacted by exposure to cold temperatures, are a minor, or while under the influence of drugs or alcohol. All information included on the Perspire Sauna Studio website is for informational purposes only.

I expressly acknowledge and agree, and agree to inform all users of the product, that I understand there are certain inherent risks and dangers associated with exposure to cold temperatures, including, but not limited to, heart failure, hypothermia, loss of consciousness, and stroke. By purchasing and using the product, I knowingly and voluntarily accept and agree to assume all risks on behalf of myself and all users of the product, both known and unknown, of illness, injury, pain, suffering, disability, or death arising therefrom. I understand that I am responsible for ensuring that users and customers properly use the product in accordance with these terms.

I understand that the manufacturer of the product, Silient, shall be named as a released party in all liability waivers signed by users of the product.

WAIVER OF LIABILITY AND ASSUMPTION OF RISK
In exchange for utilizing the services of Perspire, I expressly agree to the following:

I acknowledge and voluntarily assume the risk of injury, accident, or death that may arise from utilizing Perspire’s services and premises, including the use of an infrared sauna, cold showers, halotherapy and contrast therapy. I acknowledge that certain risks are inherent to using infrared saunas, cold showers, and contrast therapy, and I voluntarily assume those risks. I agree that this Liability and Waiver Consent Form will remain in effect during all such times as I utilize Perspire’s services and premises, including for all future infrared sauna sessions. In addition, I agree that neither Perspire nor Franchisor is responsible for any damage to any personal property used inside the sauna or brought to the Perspire premises or for lost or stolen items used inside the sauna or brought to the Perspire premises.

To the maximum extent permitted by applicable law, I and any of my heirs, executors, representatives, or assigns hereby forever hold harmless and release Perspire, Franchisor, and each of their respective owners, officers, employees, agents, and representatives from all claims or liabilities, including negligence, arising in connection with my utilization of Perspire’s services and premises.

I understand and agree that the laws of Georgia will apply to this contract.
