INFORMED CONSENT AND RELEASE ________________________ (hereinafter referred to as the “Member”) recognizes that exercise, including but not limited to yoga and the use of exercise equipment is not without some risk to the musculoskeletal system e.g. sprain, strain and cardiorespiratory system e.g. dizziness, fainting, abnormal heartbeat, discomfort in breathing, abnormal blood pressure response, and in rare instances, heart attack or stroke. Member acknowledges that not all risks can be known in advance and Member assumes these risks voluntarily. Member hereby certifies that he / she has been advised to consult with a physician before participating in any exercise program. Member confirms that he / she is not aware of any medical problems, except those listed below that would increase his / her risk of illness or injury as a result of participation in exercise programs offered by the Sweet Tea Yoga, LLC (hereinafter referred to as the “Company”). Member understands that it is his / her responsibility to inform a representative of the Company of any changes in his / her medical condition, including but not limited to pregnancy. Upon notification to the Company of a change in the Member’s medical condition, the Company’s staff will determine whether or not a change in the Member’s exercise program is warranted. Member understands that it is his / her responsibility to inform the Company’s staff immediately should any signs or symptoms of discomfort and/or distress arise during or following an exercise program. Member knowingly and voluntarily assume any and all risks associated with his / her participation in programs offered by the Company and any facilities used by the Company. Member hereby consents to the administration of first aid and resuscitative measure by the contractors, agents and employees of the Company. Member hereby releases and hold harmless the Company, its agents, employees, contractors, Company’s landlord, partners, owners or managers from any and all liability, damage, expense, causes of action, suits, claims or judgments, arising from injury, damage or loss, or claims of injury, damage or loss to Member or his/her personal property which may arise out of Member’s voluntary exercise program, including but not limited to yoga and the use of exercise equipment and Member assumes the risk of any injury. This release shall be binding upon Member’s heirs, estate, personal representatives and assigns. Member hereby authorizes the Company to use his / her name and photographic likeness in all forms and media for advertising, trade, and any other lawful purposes. In consideration of participating in exercise and any of the exercise and yoga offered by the Company, Member hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by Member in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless the the Indemnified Parties and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the classes or use of the Facilities; (3) Member represents to (a) have no medical or physical condition that would prevent Member from participating in any of the Company’s Classes and Facilities, (b) not to have a physical or mental condition that would place Member in any physical or medical danger, and (c) has not been instructed by a physician not to participate in physical exercise. Member acknowledges
that if Member have any chronic disabilities or conditions, the Members are placing themselves at risk in participating at the Company’s Classes and Facilities, and should immediately withdraw from such activities. Member has read and understood this Informed Consent and Release and accepts the conditions stated herein as a contractual requirement binding on the Member prior to and during any participation in the Company’s classes. Member understands and intend that this document will act as the broadest and most inclusive assumption of risk, waiver, release of liability and indemnification as is permitted under the laws of the State of Georgia.
