By participating in live in-person (i.e., in-studio) yoga classes, live-streamed online two-way interactive classes, hybrid yoga classes (simultaneous live in-person and live-streamed online two-way interactive classes), recorded yoga classes, series, lectures, events, and/or workshops (all of the foregoing, whether singular or plural, hereinafter referred to as the “Activities”), conducted by the Iyengar Yoga Association of Greater New York (“IYAGNY”), I agree to all the terms and conditions set forth in this agreement (this “Agreement”).
I hereby certify that I am in good physical health and do not suffer from any injury or medical condition that would limit my participation in the Activities and I understand that it is my responsibility to consult with my physician to receive approval to participate in the Activities. I take full responsibility not to exceed my personal physical abilities in the practice of the Activities.
I am aware and understand that, for safety reasons, in-person use of any props (including, but not limited to, ropes, chairs, blocks and trestles) (collectively, “Props”)), and use of the yoga studios on IYAGNY’s premises by in-person participants are not allowed outside of the Activities set forth in this agreement (this “Agreement”) and the IYAGNY Student COVID-19 Policy and Guidelines.
I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES CAN BE DANGEROUS AND CAN INVOLVE INHERENT RISKS OF SERIOUS HARM, INCLUDING, BUT NOT LIMITED TO, INJURIES (INCLUDING DEATH) AND ILLNESSES (COLLECTIVELY, “HARMS”). I ACKNOWLEDGE THAT ANY HARMS I MAY SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OR OTHERWISE OF THE RELEASEES (AS DEFINED HEREIN). I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH AN EXPRESS UNDERSTANDING OF THE POTENTIAL DANGERS INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF HARMS, WHETHER CAUSED BY THE NEGLIGENCE OR RESPONSE OF THE RELEASEES OR OTHERWISE, EXCEPT TO THE EXTENT CAUSED BY ANY OF THE RELEASEES’ GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
I am aware and understand that the Iyengar yoga method taught during the Activities may involve physical adjustments (through the medium of Props and/or hands-on physical adjustments) and that, by participating in the Activies, I consent to such physical adjustments during the Activities unless I expressly revoke such consent, which I may do so at any time.
I am aware and understand that IYAGNY does not provide lockers and that I am solely responsible for any personal items brought on IYAGNY’s premises (in the case of in-person Activities) and any personal items in my possession (in the case of online or recorded Activities). IYAGNY is not responsible for, and assumes no liability arising from, theft of, damage to, or loss of, any personal item.
I am aware and understand that if I participate in live-streamed online two-way interactive classes (or hybrid classes as a non-in-person student), if my device’s camera is on, then other students and the instructor will be able to see me on their screen. Instructors will have the ability, in their sole discretion, to mute my microphone and turn off my camera. I understand that I have the option to turn off my camera and microphone at any time, and that instructors cannot turn on my camera without my consent. Further, I understand that when I sign-up for live-streamed online two-way interactive classes (or hybrid classes as a non-in-person student), my name will be shared with the instructor for that class. In addition, I am aware and understand of the possibility of another student making unauthorized recordings of the Activities and will hold IYAGNY and Authorized persons (defined below) harmless for such unauthorized recordings.
By participating in Activities, I irrevocably give IYAGNY my permission, and grant to IYAGNY the right, to film, record, and photograph me (the “Recording”). I hereby irrevocably grant and license to IYAGNY and its affiliates, successors, licensees, agents, and assigns ("Authorized Persons") the rights to digitize, modify, alter, edit, adapt, or otherwise use, the Recording, including my name, image, likeness, appearance, and voice as they appear in the Recording, without further consent from me.
I agree that IYAGNY is and will be the sole and exclusive owner of all right, title, and interest in and to the Recording (including all film, photographs, and other recordings, including outtakes and behind-the-scenes footage), including all copyrights and other intellectual property rights therein, in perpetuity throughout the universe.
I am aware and understand that IYAGNY has no obligation to use the Recording, or create, produce, advertise, or promote the Recording, or to exercise any rights granted under this Agreement. I acknowledge and agree that I have no right to review or approve the Recording before they are used by IYAGNY or at any other time, and that IYAGNY has no liability to me for any editing or alteration of the Recording, or for any distortion or other effects resulting from IYAGNY’s editing, alteration, or use of the the Recording, or IYAGNY’s presentation of me. Any acknowledgment or credit of me in connection with the Recording, if any, shall be determined by IYAGNY in IYAGNY’s sole discretion.
