Because physical exercise can be strenuous and subject to risk of serious injury, JTB Wellness urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You agree that if you engage in any physical exercise or activity, or use any Studio amenity on the premises, you do so entirely at your own risk. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, seizures due to light effect, damage or even death, or loss of by theft of any personal property. You expressly agree to release and discharge JTB Wellness, Inc. and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action.
This waiver and release of liability includes, without limitation, all injuries to you which may occur, regardless of negligence, as a result of (a) your use of any exercise equipment, products and Studio amenities, (b) the sudden and unforeseen malfunctioning of any equipment, (c) our instruction or supervision, and (d) your slipping and/or falling while in the Studio, or on the Studio premises, including adjacent sidewalks and parking areas.
JTB Wellness, Inc. is in no way responsible for the safekeeping of my personal belongings while I attend class. By signing this waiver, you also grant JTB Wellness permission to record, reproduce and display your likeness on all social media platforms, website, and printed marketing materials.
COVID-19 Addendum:
The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and believed to spread mainly from person-to- person contact. As a result, federal, state and local governments and health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
JTB Wellness Inc, (“JTB”) has put in place preventative measures to attempt to reduce the spread of COVID-19 during our classes; however, JTB cannot guarantee that you will not become infected with COVID-19. Further, attending JTB classes could increase your risk of contracting COVID-19.
By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed or infected by COVID-19 by attending JTB classes and that such exposure or infection may result in health complications including personal injury, illness, disability and death.
Further, by signing this agreement, you acknowledge that you understand that the risk of becoming exposed to or infected by COVID-19 while attending JTB classes may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, other JTB members and students, employees and other persons that may be present. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself, illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with your attendance and/or participation in JTB classes ("Claims"). You hereby release, covenant not to sue, discharge and hold harmless JTB Wellness, Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.
You acknowledge that you have carefully read this waiver and fully understand that it is a release of liability. You agree to voluntarily give up any right that you may otherwise have to bring a legal action against the Studio for negligence, or any other personal injury or property damage or loss action.
