To the best of my knowledge I am in good physical health and fully able to perform within my abilities the yoga, fitness, and stretching exercises which I choose to participate in and practice during my enrollment at the Greenheart Healing Arts Center. I will faithfully practice within my physical limits, honor modifications, and listen to my body, being understood that any deviation shall be at my own risk.

I will inform the instructor of any pre-existing conditions, recurring injuries, and any and all other health conditions as they arise and that this information is held in the strictest confidence.

I agree to inform the instructor of my preferences to accept or decline gentle adjustments in the course of my yoga practice/training.

The use of the facilities at Greenheart Healing Arts Center naturally involves the risk of injury to me and/or my guest(s), whether I or someone/ something else causes it. As such, I understand and voluntarily accept this risk. I agree that Greenheart or any person or entity in any way involved therewith will not be liable for any injury or damage, including, without limitation, personal, bodily or mental injury, economic loss, or any damage to me resulting from the negligence of Greenheart Healing Arts Center, its employees, officers, directors, agents, and contractors, or anyone using Greenheart Healing Arts Center’s facilities. I waive any claims arising from my use of Greenheart Healing Arts Center’s facilities whatsoever or from mere presence on the premises of Greenheart Healing Arts Center.

I am aware that Greenheart Healing Arts Center is an organization that is here to serve me by sharing its knowledge of yoga and health. I understand and agree that I will receive instruction in yoga and/or meditation and that I hold harmless Greenheart Healing Arts Center, or any person or entity in any way involved therewith for any damage to or theft of personal property on or away from Greenheart’s premises, or personal injury, including but not limited to bodily injury, disease, disability, death, humiliation, or consequential loss of any kind arising out of my participation in any Greenheart event or activity.

I will not hold any yoga or fitness teachers of Greenheart Healing Arts Center responsible for any injuries suffered by me in whole or in part by my failure to honor my physical limits and listen to my body, or by not fully disclosing any physical impairment that might require special modifications.

In the event that I am pregnant, I will not attend a yoga class until I have discussed the potential risks to me or my unborn child/fetus with my obstetrician. I agree that I will follow my obstetrician’s recommendations and on behalf of myself, my heirs, spouse or other interested party hold harmless Greenheart for any possible injury to myself or my unborn child/fetus.

If I am under 18 years of age, I will disclose my age to Greenheart and provide my signature and the signature of my parent or legal custodian or guardian at the studio prior to taking class. (Note: No one under the age of 16 is allowed to practice hot yoga).

Any dispute arising out of or relating to this Waiver of Liability/ Hold Harmless Agreement, or the breach thereof, shall be finally resolved by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the arbitration award may be entered in any court having jurisdiction.

Any provision not in conformity with the law of the state of California or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable.

I affirm that I alone am responsible for my health and I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Greenheart Healing Arts Center and the yoga and fitness teachers of Greenheart Healing Arts Center. My signature also gives Greenheart Healing Arts Center permission to use any audio, video, or photo materials in which I and/or my child is present for promotional purposes without an additional release on my and/or my child’s part. My signature is binding to this liability waiver from this day forth.
