CONDITIONS OF PARTICIPATION & MEMBERSHIP
The undersigned (the “Participant”) acknowledges and agrees that the execution of this Conditions of Participation & Membership Agreement (“Agreement”) is being executed in connection with the following list of activities and events, whether as a member or guest, at 19022 Aurora Ave N, Shoreline, WA 98133 (the “Premises”) which are owned and/or operated by Freelance Contracts, Inc. DBA Get Strong First (“GSF”): Participation in services, activities, training, and/or classes at or by GSF (whether on or off the Premises); use of GSF equipment (whether on or off the Premises); and use of GSF throwing net.
Medical: It is the responsibility of the participant to ensure that they are medically fit to participate in strenuous strength and conditioning activities. As stated below, participation in physical fitness activities presents an inherent risk of injury to person or property. The undersigned certifies that the above named Participant has no known conditions that prohibit, or limit participation in any strength training, physical fitness activities, or other exercise, held by or in association with GSF.
Conduct and right to use the facility: Participant agrees to abide by all policies and procedures of GSF. Participants signing this waiver must behave in a respectful manner to both person and property at the facility and during training. Behavior, which could potentially lead to intentional or unintentional bodily injury, damage to property or interruption of events will not be tolerated. Failure to act in accordance with these rules may result in a participant’s expulsion from the Premises and all other activities at the facility and/ or revocation of membership.
Property Loss: Participant acknowledges that GSF is not responsible for personal property lost, damaged or stolen while using GSF facilities or participating in GSF programs.
Insurance: Participant understands that GSF does not provide any accident or health insurance for its members or participants and further understands that it is the participant’s responsibility to provide such coverage.
Risk Acknowledgement: Participant understands that not all activities, exercises and training methods are appropriate for all people and may, in some cases, cause injury, aggravate existing injuries, or illness. Participant understands that all exercises, training methods and concepts are to be used at their own risk. Participant acknowledges that if they are uncomfortable with any activity, exercise or training program within the course that they may immediately state so, and that it is their right and responsibility to remove themselves from the situation immediately and that they am encouraged to do so.
Liability Waiver:In consideration of being permitted to utilize the Premises, facilities, services and programs of GSF for any purpose including, but not limited to, observation or use of facilities and equipment and participation in any program affiliated with GSF without respect to location, I, on behalf of myself and any children, dependents or personal representatives, hereby:
- Acknowledge that I have (a) read this release and waiver of liability; (b) had the opportunity to inspect the Premises and GSF's facilities and equipment or will immediately upon entering or participating will inspect and carefully consider such Premises, facilities or program; (c) accept the facilities, equipment and program as being safe and reasonably suited for the purposes intended and (d) voluntarily sign this release and waiver of liability.
- Release GSF, its directors, officers, employees, agents and volunteers (collectively "GSF Releases") from all liability to me for any loss or damage to property or injury or death to person, whether caused by the ordinary negligence of the GSF Releases or any other person, and while I am in, upon or about any GSF branch or any facilities or equipment therein or participating in any program or service affiliated with the GSF.
- Agree not to sue the GSF Releases for any loss, liability, damage, injury or death described above and I agree to indemnify and hold harmless the GSF Releases and each of them from any loss, damage or cost they may incur due to my presence in, upon or about GSF or any facilities or equipment therein or my participation in any program or service affiliated with the GSF whether caused by the ordinary negligence of the GSF Releases or by any other person. I assume full responsibility for the risk of such loss, liability, damage, injury or death.
I HAVE READ AND UNDERSTAND THE TERMS OF THIS AGREEMENT, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, ORAL OR WRITTEN. I INTEND FOR THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW. I AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
FOR PERSONS OF MINORITY AGE
This is to certify that I, as the parent or guardian with legal responsibility for this minor, do consent and agree not only to his/her release, but also for myself, and my heirs, assigns and next of kin to release and indemnify the GSF Releases from any and all liability incident to my minor child's involvement as stated above, to the fullest extent permitted by law.
