KAIA FIT SIERRA WAIVER AND RELEASE OF LIABILITY
The undersigned (“Releasor”) acknowledges that participation in any physical training activity, including, but not limited to fitness classes with a Kaia FIT franchise (“Kaia FIT Sierra”) is a strenuous activity which is beyond the capability of some people, and may cause minor, severe and/or permanent injuries or death. Releasor agrees on behalf himself/herself to participate in such training at his/her own risk. Releasor recognizes that Kaia FIT Sierra has not evaluated Releasor’s ability to participate in such training, nor will Kaia FIT do so at any time during Releasor’s participation. Releasor also recognizes that any advice dispensed by Kaia FIT Sierra, its employees, agent, directors or officers may not be appropriate for Releasor, and it is Releasor’s responsibility to make this determination.
Releasor acknowledges that Kaia FIT Sierra’s training is an extreme test of a person’s physical and mental limits and carries with it, regardless of physical fitness or experience, the potential for death, serious injury and property loss. Releasor hereby assumes the risks of participating in such training and certifies that his/her level of physical fitness is appropriate to participate in the training which Releasor is voluntarily undertaking. Releasor certifies that he/she has sufficiently trained or prepared for such training and that Releasor has not been advised against participation in such activity by a qualified health care professional. If you are currently under a physician’s care for an injury, condition or illness, Kaia FIT Sierra strongly urges you to consult with your physician before participating in the Kaia FIT Sierra program.

In consideration of being allowed to participate in the Kaia FIT program, Releasor personally assumes all risk involved in the participation of fitness classes with Kaia FIT Releasor, for himself/herself, his/her past, present and future agents, attorneys, representatives, predecessor, successors, assigns, heirs and executors also waives and releases, now and forever, all claims and causes of action against Kaia FIT, its Franchisor, its past, present and future members, officers, agents, representatives, contractors, attorneys, employees, successors and assigns (collectively “Releasees”) from any and all matter of liability, claims for damages, causes of action, suits, proceedings, compensation, attorney’s fees, costs and expenses of suits, claims and demands whatsoever, which may arise from Releasor’s participation in Kaia FIT’s training, including, but not limited to, any and all claims, losses or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft or damage of any kind, including economic losses, which may arise out of or relate to Releasor’s participation in Kaia FIT’s training. Releasor further holds Kaia FIT harmless from any loss to personal property which is lost or stolen while present at a Kaia FIT facility or while participating in a Kaia FIT class.

Releasor acknowledges that there may be motor vehicles, cycles (motor-driven or otherwise), persons (whether on foot, cycle or otherwise), dangerous or adverse road/trail/route or water conditions, road/trail/route or water hazards, water-craft, obstacles or other objects present in water, wildlife, marine life or other animals present during Kaia FIT’s training, and Releasor hereby assumes the risk related thereto. Releasor additionally acknowledges that some outdoor activities may take place in remote locations with limited or no cell phone service and/or with limited access to emergency personnel. Releasor hereby assumes any and all risk related to engaging in activities in remote locations. Releasor hereby assumes any and all other risks associated with participating in Kaia FIT training, including, but not limited to contact or effects of other participants and effects of weather.
