I have been examined by a licensed physician within the past six months and have been found by such physician to be in good physical health and fully able to perform all yoga exercises which I am to learn and perform during my enrollment. I agree to faithfully follow all instructions given to me by instructors as to when, where and how to perform and not to perform yoga exercises it being understood that any deviation by me from such instructions shall be at my own risk.

 

I also agree to give my consent to all the photos and video recordings taken at the studio for the studio usage purpose on BYR website and the social media pages. I understand that the tuition paid herewith and such registration fees paid hereafter are non-refundable and non-transferable. I further understand that at the instructor's discretion, I could be asked to leave the class if found to be disruptive to others. The class fees and class times are subject to change or cancellation at any time without notice.

 

I hereby acknowledge, understand and agree that by taking part in yoga classes at Bikram Yoga Rockville, LLC there is a possibility of physical injury or illness and I am assuming the risk of such illness or injury by participation. Therefore, in consideration of allowing me to participate, and for other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged and agreed, I agree to release and hold harmless Bikram Yoga Rockville, LLC including its officers, instructors, members, contractors, agents and personnel from any and all liability (including reasonable attorney's fees) for any claim whatsoever, including any claim arising out of any injury or illness incurred by me while participating in yoga classes and/or while on the Company's premises, whether or not caused by the negligence of any of the Company's members, personnel or contractors.

The presence of any online streaming class content does not constitute a waiver of any right in such content. You do not acquire ownership rights to any such content viewed online. Except as otherwise provided herein, none of this content may be used, copied, reproduced, distributed, republished, downloaded, modified, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without our express prior written permission.

Additional BYR Lability Waiver and Client Responsibility Agreement:

The following constitutes a waiver of certain legal rights and remedies, and you should therefore read this Liability Waiver and Client Responsibility Agreement (“Agreement”) carefully. In this Agreement, the terms “You,” “I,” and “Me” refer to you, the Client, that has signed at the end of this Agreement, and your heirs, assigns, successors, personal representatives, and legal representatives. In this Agreement, the term “BYR” refers to Bikram Yoga Rockville, LLC and its affiliates, owners, employees, agents, representatives, coaches, and instructors.

Release and Assumption of Risk:

I hereby release and forever discharge BYR from any and all claims, suits, and causes of action of any nature whatsoever, including (but not limited to) claims, suits, and causes of action for property damage of loss, personal injury, and wrongful death, that in anyway arise from or relate to my use of, or participation in, BYR’s services, facilities, or products, whether such claims, suits, or causes of action were caused by gross negligence, negligence, or otherwise. Accordingly, I covenant and agree that I will not sue or take any legal action of any nature against BYR relating to property damage or loss, personal injury, wrongful death, loss of consortium, or otherwise. The scope of the foregoing release includes, but is in no way limited to, claims, suits, or causes of action relating to any exposure I might have to Covid-19 or any other virus, bacterial infection, infectious disease, or other malady as a result of my usage of, or participation in, any BYR service, facility, or product. I hereby knowingly and voluntarily assume all risk of property damage and loss, personal injury, and wrongful death that might arise by virtue of my use of or participation in, any BYR service, facility, or product.

I understand and acknowledge that the novel coronavirus, COVID-19, has been declared a worldwide pandemic with the World Health Organization and the U.S. Center for Disease Control. I understand that COVID 19 is highly contagious and believed to be spread by person-to-person contact.

I acknowledge that the owners and teachers of BYR have put in place reasonable preventative measures targeted to reduce the spread of COVID-19.

However, I fully acknowledge that BYR cannot guarantee that I will not be infected with COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID 19 and voluntarily assume the risk that I may be exposed to or infected by COVID 19, and that such exposure or infection may result in illness, personal injury, permanent disability or death to myself or those with whom I may have contact. By signing this waiver, I agree to all of the following:

1. I understand that the risk of becoming exposed to or infected by COVID 19 may result from the actions, omissions, or negligence of myself or others, including but not limited to members, staff or teachers at BYR.

2. I voluntarily assume all of the foregoing risks and accept sole responsibility for any illness or injury to myself (including, but not limited, to personal injury, illness, disability or death), damage, loss, claim, liability, or expense of any kind that I may experience in connection with my attendance or participation at BYR.

3. I hereby release, covenant not to sue, discharge and hold harmless BYR its employees, agents and representatives, of and from any and all claims, including liabilities, claims, actions, damages, costs, or expenses of any kind relating in any way to COVID 19.
