In exchange for utilizing the services of Supreme Machine, LLC dba Perspire Sauna Studio Costa Mesa (“Perspire”), a California limited liability company and an independent franchisee of SUPREME MACHINE, LLC, a California limited liability company (“Franchisor”), the undersigned acknowledges that he/she has read and fully understands the following terms, knowingly assumes the risks, and waives his/her rights concerning liability as set out below.
Please consult your physician if you are pregnant, on medication, or if you have any questions regarding your ability to use an infrared sauna and/or cold shower modalities due to health reasons. NO INFORMATION WE PROVIDE YOU WITH RESPECT TO INFRARED SAUNAS, COLD SHOWERS, HALOTHERAPY, OR CONTRAST THERAPY IS MEDICAL ADVICE, AND WE DISCLAIM ALL LIABILITY WITH RESPECT TO ANY BELIEF THAT SUCH INFORMATION IS MEDICAL ADVICE.
Perspire Sauna Studio Costa Mesa has put in place preventative measures to reduce the spread of COVID-19. However, we cannot guarantee that you will not become infected with COVID-19. Use of our facilities could increase your risk of contracting this disease.
INFRARED SAUNA AGREEMENT/ ACKNOWLEDGEMENT
Please consult your physician if you are in doubt regarding your ability to use the infrared sauna for health reasons.
1. You must be 18 years of age or older to use Perspire’s infrared sauna alone. With management permission, minors 16 to 17 years of age may use the sauna so long as a parent or guardian executes the consent form and waiver of liability on behalf of the minor and accompanies the minor every session.
2. Using an infrared sauna and/or cold shower can cause light-headedness, dizziness, heat exhaustion, or hypothermia. You should stay hydrated by drinking at least 8oz of water before, during, and after your session, and eat something beforehand. Stop using the sauna if you feel unwell. Cold showers can reach temperatures as low as 45°F; use them with caution. Start with brief exposure to assess your tolerance and gradually increase the time as comfortable. Severe reactions like heat stroke or cold shock can be life-threatening. Before combining halotherapy with an infrared sauna, consult your healthcare provider, particularly if you have any pre-existing health conditions. Discontinue use immediately if you experience discomfort or health concerns.
3. The use of medication, drugs, or alcohol prior to or during the sauna session may lead to dizziness or unconsciousness.
4. Sauna sessions are limited to 40 minutes, and temperatures must stay below 170 degrees Fahrenheit. Cold shower exposure should be adjusted based on personal comfort and health conditions.
5. You are limited to one (1) 40-minute sauna session daily (not per studio).
6. If you are late for your appointment, time will be deducted from your session.
7. If you book an appointment and need to cancel, you must do so within two hours of the scheduled time. Late cancellations (less than two hours before appointment) will result in a $20 late cancellation fee and will be charged to your card on file.
8. If you do not attend your appointment, a $20 no-show fee will be charged to your card on file.
9. Inappropriate behavior or activities will not be tolerated. Guests exhibiting inappropriate behavior will be required to leave the studio and may not be allowed to return.
10. Smoking and vaping are prohibited in the studio at any time. Offenders will be banned.
11. Firearms are always prohibited in the studio. Offenders will be banned from the premises.
12. If you cause damage to any Perspire property, including, without limitation, physical damage, water damage, damage due to harmful substances or odors, or damage from bodily fluids other than perspiration, you will be required to pay a damage fee which will be charged to your card on file.
WAIVER OF LIABILITY AND ASSUMPTION OF RISK
In exchange for utilizing the services of Perspire, I expressly agree to the following:
I acknowledge and voluntarily assume the risk of injury, accident, or death that may arise from utilizing Perspire’s services and premises, including the use of an infrared sauna, cold showers, and contrast therapy. I acknowledge that certain risks are inherent to using infrared saunas, cold showers, and contrast therapy, and I voluntarily assume those risks. I agree that this Liability and Waiver Consent Form will remain in effect during all such times as I utilize Perspire’s services and premises, including for all future infrared sauna sessions. In addition, I agree that neither Perspire nor Franchisor is responsible for any damage to any personal property used inside the sauna or brought to the Perspire premises or for lost or stolen items used inside the sauna or brought to the Perspire premises.
To the maximum extent permitted by applicable law, I and any of my heirs, executors, representatives, or assigns hereby forever hold harmless and release Perspire, Franchisor, and each of their respective owners, officers, employees, agents, and representatives from all claims or liabilities, including negligence, arising in connection with my utilization of Perspire’s services and premises.
I understand and agree that the laws of California will apply to this contract.
